Please find hereunder our newsletter regarding the extract of the Draft of the Guidelines for the Publishing of the Resolutions of the Plenary of the Federal Commission of Economic Competition, prepared by our team of professionals in Zozayacorrea Sahagún Arizaga Abogados y Fiscalistas.

 
On November 13th, 2018, an extract of the Draft of the Guidelines for the Publishing of the Resolutions of the Plenary of the Federal Commission of Economic Competition ("Guidelines") was published in the Official Federation Gazette ("DOF").
 
The purpose of these Guidelines is to establish the applicable rules and principles for the publishing of the resolutions issued by the Plenary of the Federal Commission of Economic Competition ("COFECE"),  as well as the means through which they may make themselves available, may using for this purpose any means of communication, including reports or periodic reports, press releases, social networks, press conferences or interviews, provided that the output used, indicates the location where the public versions of the information disseminated may be consulted.
 

It should be noted that in the case of procedures derived from investigations, incidents and concentrations, the publishing of the resolution must indicate whether the resolution is final, or whether it is susceptible to be challenged and, in the event that there is knowledge of the existence of a legal recourse filed against the resolution due to this situation, notified to  the COFECE by the competent authority, this circumstance must be indicated at the time of the publishing of the resolution.

 
Also, in cases where a competent jurisdictional authority rules ordering to modify or leave without effect a resolution of the Plenary of theCOFECE, such circumstance must be disseminated by the Commission itself through any means of communication, making reference to the original publishing, once the corresponding order has been completed.
 

Finally, the interested parties will have a term of thirty (30) business days computed from the publication of the Guidelines in the DOF, in order to present to theCOFECE their opinions regarding the content of these.
